Please read these Terms carefully before using our Service. By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use our Service.

These Terms constitute a legally binding agreement between you and Reviser. By creating an account, using our services, or accessing our platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

We reserve the right to modify these Terms at any time. Your continued use of the Service after any changes constitutes your acceptance of the modified Terms. It is your responsibility to review these Terms periodically for updates.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Service

Reviser is an educational technology platform that provides AI-powered tools for creating study materials, including:

• Quiz generation from uploaded content (PDFs, PowerPoints, YouTube videos, text)

• Flashcard creation and management

• AI-generated notes and summaries

• Study material organization and storage

• Interactive quiz-taking and assessment tools

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We do not guarantee that the Service will be available at all times or that it will be error-free.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We strive to provide accurate and reliable services, but we do not guarantee the accuracy, completeness, or usefulness of any information or materials generated by our AI tools.

3. User Accounts and Registration

To access certain features of the Service, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information

• Maintain and promptly update your account information

• Maintain the security of your password and account

• Accept responsibility for all activities that occur under your account

• Notify us immediately of any unauthorized use of your account

• Be at least 13 years of age (or the age of majority in your jurisdiction)

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to protect your account information.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. User Conduct and Responsibilities

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Upload, post, transmit, or share any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable

• Upload content that infringes on any intellectual property rights, including copyrights, trademarks, patents, or trade secrets

• Upload content containing personal information of others without their consent

• Use the Service to violate any local, state, national, or international law or regulation

• Attempt to gain unauthorized access to any portion of the Service, other accounts, computer systems, or networks

• Interfere with or disrupt the Service or servers or networks connected to the Service

• Use automated systems (bots, scrapers, crawlers) to access the Service without our express written permission

• Reverse engineer, decompile, or disassemble any part of the Service

• Remove, alter, or obscure any proprietary notices or labels on the Service

• Use the Service to transmit viruses, malware, or other harmful code

• Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity

• Collect or store personal data about other users without their consent

• Use the Service for any commercial purpose without our express written consent

• Violate any applicable laws or regulations

You are solely responsible for all content you upload, create, or share through the Service. You represent and warrant that you own or have the necessary rights to use and authorize us to use any content you submit.

We reserve the right to remove any content that violates these Terms or that we determine, in our sole discretion, is harmful, offensive, or inappropriate.

5. Intellectual Property Rights

Our Intellectual Property:

The Service, including all content, features, functionality, design, text, graphics, logos, icons, images, audio clips, video clips, and software, is owned by Reviser or its licensors and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works of any part of the Service without our express written permission.

Your Content:

You retain ownership of any content you upload or create using the Service ("User Content"). However, by uploading or creating content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display your User Content solely for the purpose of providing and improving the Service.

You represent and warrant that your User Content does not infringe on the rights of any third party, including intellectual property rights, privacy rights, or publicity rights.

Generated Content:

•Study materials generated by our AI tools (quizzes, flashcards, summaries) are created based on your uploaded content. You own the generated materials, but we retain rights to the underlying AI technology and algorithms used to create them.

You may not use generated content for commercial purposes that compete with our Service without our express written consent.

6. Payment Terms and Subscription

Some features of the Service may require payment or a subscription. By purchasing a subscription or making a payment, you agree to:

• Pay all fees associated with your account

• Provide accurate billing information

• Authorize us to charge your payment method

Subscription Plans:

• Subscriptions are billed on a recurring basis (monthly or annually) as selected during purchase

• Subscription fees are charged in advance for the billing period

• Subscriptions automatically renew unless cancelled before the renewal date

• You may cancel your subscription at any time through your account settings

Refunds:

• Refund policies vary by subscription plan and are subject to our refund policy in effect at the time of purchase

• We reserve the right to refuse refunds for accounts that violate these Terms

• Refund requests must be submitted within the timeframe specified in our refund policy

Price Changes:

We reserve the right to modify subscription prices at any time. Price changes will not affect your current subscription period but will apply to subsequent renewal periods. We will notify you of any price changes in advance.

Payment Processing:

Payments are processed by third-party payment processors. We are not responsible for any errors or issues arising from payment processing. You agree to provide current, complete, and accurate purchase and account information for all purchases.

7. Prohibited Uses

You may not use the Service:

• In any way that violates any applicable law or regulation

• To transmit, or procure the sending of, any advertising or promotional material without our prior written consent

• To impersonate or attempt to impersonate us, our employees, another user, or any other person or entity

• In any way that infringes upon the rights of others, including intellectual property rights

• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service

• To introduce any viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful

• To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service

• To attack the Service via a denial-of-service attack or a distributed denial-of-service attack

• To use the Service in any manner that could disable, overburden, damage, or impair the Service

• To use any robot, spider, or other automatic device, process, or means to access the Service for any purpose without our express written permission

Violation of these prohibitions may result in immediate termination of your account and may subject you to legal action.

8. Termination

Termination by You:

You may terminate your account at any time by contacting us or using the account deletion feature in your account settings. Upon termination:

• Your access to the Service will be immediately suspended

• Your account and associated data may be deleted in accordance with our data retention policies

• Any unused subscription time will not be refunded unless required by law

Termination by Us:

We reserve the right to suspend or terminate your account immediately, without prior notice, if you:

• Violate these Terms or our Privacy Policy

• Engage in fraudulent, abusive, or illegal activity

• Use the Service in a manner that could harm us or other users

• Fail to pay required fees

• Are inactive for an extended period (as defined in our policies)

Upon termination by us, your right to use the Service will immediately cease. We may delete your account and all associated data, subject to our data retention policies and legal obligations.

Effect of Termination:

Upon termination, all licenses and rights granted to you under these Terms will immediately terminate. Provisions that by their nature should survive termination (including intellectual property rights, disclaimers, limitations of liability, and dispute resolution) will survive.

9. Disclaimers

Service Availability:

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free

• The results obtained from using the Service will be accurate or reliable

• The quality of any products, services, information, or other materials obtained through the Service will meet your expectations

• Any errors in the Service will be corrected

AI-Generated Content:

•Content generated by our AI tools (quizzes, flashcards, summaries) is created automatically and may contain errors, inaccuracies, or omissions. We do not guarantee the accuracy, completeness, or usefulness of AI-generated content. You are responsible for reviewing and verifying any generated content before using it for educational or other purposes.

Third-Party Content:

The Service may contain links to third-party websites, services, or resources. We are not responsible for the availability, accuracy, or content of such third-party resources. Your use of third-party resources is at your own risk.

Educational Use:

•While our Service is designed for educational purposes, we do not guarantee that use of the Service will result in improved academic performance or achievement. The effectiveness of study materials depends on various factors beyond our control.

To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Reviser, its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, data, or use

• Loss of goodwill or business opportunities

• Costs of procurement of substitute goods or services

• Personal injury or property damage

• Any other damages arising out of or in connection with your use of the Service

Our total liability to you for all claims arising out of or relating to the use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

You acknowledge and agree that the limitations of liability set forth in this section are fundamental elements of the basis of the bargain between you and us, and that we would not be able to provide the Service on an economic basis without such limitations.

You agree to indemnify, defend, and hold harmless Reviser, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the Service

• Your violation of these Terms

• Your violation of any rights of another party

• Your User Content

• Any content you upload or generate using the Service

• Your violation of any applicable law or regulation

We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with us in asserting any available defenses. You agree not to settle any matter without our prior written consent.

12. Dispute Resolution

Governing Law:

These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions.

Dispute Resolution Process:

If you have any dispute with us, you agree to first contact us at support@reviser.co.za to attempt to resolve the dispute informally. If we cannot resolve the dispute informally within thirty (30) days, you agree to resolve the dispute through binding arbitration.

Arbitration:

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be settled by arbitration in accordance with the rules of the Arbitration Foundation of South Africa (AFSA). The arbitration shall be conducted in South Africa, and the language of the arbitration shall be English.

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to a jury trial.

Exceptions:

•Notwithstanding the above, we may seek injunctive or other equitable relief in any court of competent jurisdiction to protect our intellectual property rights or to prevent unauthorized use of the Service.

Jurisdiction:

•For any disputes not subject to arbitration, you agree to submit to the exclusive jurisdiction of the courts of South Africa.

13. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

• Notify you of material changes via email (if you have provided an email address) or through a prominent notice on our website

• Post the updated Terms on this page

14. Miscellaneous Provisions

Entire Agreement:

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Reviser regarding your use of the Service and supersede all prior agreements and understandings.

Severability:

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

Waiver:

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment:

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms or any rights hereunder without restriction.

Force Majeure:

We shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, labor disputes, or internet or telecommunications failures.

Notices:

All notices, requests, and other communications under these Terms must be in writing and delivered to support@reviser.co.za or to our registered address.

Relationship:

These Terms do not create any partnership, joint venture, employment, or agency relationship between you and Reviser.
